Introduction

These Terms and Conditions (“Terms”) apply to your use of the Dashing Pets website, operated in the Republic of South Africa. By accessing or using this site, you agree to be bound by these Terms, which comply with South African law, including the Consumer Protection Act (CPA), Electronic Communications and Transactions Act (ECTA), and Protection of Personal Information Act (POPIA).

Throughout this site, references to "we," "us," and "our" pertain to Dashing Pets which also includes Dashing Pets officers, agents, employees, owners, co-branders and associates. “You” or “your” refers to any individual or entity accessing this website, encompassing any associated persons, websites, businesses, or agents, including virtual or automated agents connected with the visitor.

1. Legal Capacity

You must be 18 years or older or have legal capacity under South African law to enter into binding contracts. By using our website, you confirm you meet these requirements.

2. Products & Availability

All items displayed are subject to availability. We will make reasonable efforts to ensure stock is up to date.

If a product is unavailable after purchase, you will be offered a refund or a suitable alternative, in accordance with section 23 of the CPA.

3. Pricing

Prices are in South African Rand (ZAR) and include VAT unless otherwise stated. Prices are subject to change without notice. If an error in pricing is found, we reserve the right to correct it and offer you the option to proceed at the correct price or cancel the order.

4. Orders & Cancellations

Orders are only confirmed once full payment is received. You may cancel an order before dispatch by contacting us via phone. If a cancellation is requested after shipment, it will be handled under our Returns Policy. We reserve the right to cancel an order for legitimate reasons (e.g., fraud suspicion, pricing errors, stock issues), with full refunds where applicable. 

Unpaid orders will be cancelled after 5 days. Price, promotional discounts or offers applied at the time you placed your order will be forfeited on cancelation of order. We reserve the right to cancel your order earlier should there be a price change or an expiry date on promotional offers and discounts.

5. Delivery

Delivery is only available within South Africa. Estimated delivery times range from 2 to 7 business days, depending on your location. Delivery fees are calculated at checkout and is subject to the weight of products ordered and location of delivery.

Under ECTA, risk passes to you upon delivery confirmation. Please inspect parcels on delivery.

6. Returns  & Refunds (CPA-Compliant)

You have a 7-day cooling-off period for online purchases under section 44 of ECTA, allowing you to return items at your own cost. Returned items must be unopened, unused, and in original packaging. Defective or damaged goods will be replaced or refunded in accordance with sections 55 and 56 of the CPA.

Certain products are non-returnable for health and safety reasons (e.g., opened food, grooming products, customised items).

7. Payment

8. Account Registration

You agree to only provide and submit accurate truthful information to us and this website.

You may register for a personal account to manage orders and track delivery. You are responsible for safeguarding your login credentials. We reserve the right to disable accounts for misuse or suspected fraud.

9. Privacy & Data Protection (POPIA)

Your personal information is processed lawfully and securely, as required by the Protection of Personal Information Act (POPIA).
We do not share or sell your data without your consent, except as required for processing your order and delivering your order.

10. User Submissions and Feedback

If you send us any submissions, be it photos, videos, information, comments, creative ideas, feedback etc, you agree that we may, at any time, edit, copy, publish, distribute, translate and use it in any way or medium that we see fit.

We are not responsible for the accuracy and completeness of information on this website. We also do not guarantee that the information is up to date. We do try our best to keep all information as accurate and reliable as possible.

We do make use an artificial intelligence (AI) in some of our product descriptions, and therefore information available on our website may contain inaccuracies, omissions, or errors. While we strive for accuracy, AI-generated content is subject to limitations inherent in the technology.

By using our website and purchasing our products you acknowledge that some information on our website may contain errors, omissions and inaccuracies. Dashing Pets will not be held liable for any damages or loss from the reliance on the information and product descriptions provided on the website.

12. Promotions and Vouchers

Discount codes and vouchers are subject to individual terms, including expiration dates.
Only one promo code may be used per order, unless otherwise stated.

13. Intellectual Property

All rights, title and ownership of this website are the sole property of Dashing Pets. All content and trade marks (including images, branding, product descriptions, logos, etc.) belongs to Dashing Pets or our licensors and may not be copied, reproduced, or redistributed without permission. If you do breach this “term” we may claim for damages or specific performance against you. We may also take other steps against you that falls within the laws of South Africa, without affecting our rights. 

14. Limitation of Liability

Your use of this website is at your own risk, and we disclaim all warranties regarding its use. We do not offer any guarantees or assurances related to your use of this website. Specifically, we do not affirm that the website is suitable for any specific purpose, complete, accurate, or secure. Additionally, we do not guarantee that the website is free from errors, defects, malicious software, or infringing content, nor that your use of it will be uninterrupted or error-free.

We do our best to ensure the accuracy of content and safety of products. However, to the fullest extent allowed by law, we are not liable for indirect or consequential damages from use of the website or products.

15. Indemnity

By accessing or using this website, you agree to indemnify, defend, and hold harmless Dashing Pets, its directors, officers, employees, agents, and affiliates from any and all claims, losses, damages, liabilities, and expenses (including legal fees) arising directly or indirectly from your use of this website or buying and using the products from this website.

We may provide you with access to third party tools and links over which we have no control or input. Using these tools and links are completely at your own risk. 

17. Dispute Resolution

In the event of a dispute, we encourage you to contact us directly.

If unresolved, disputes may be referred to the Consumer Goods and Services Ombud (CGSO) or resolved via arbitration under South African law.

18. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

19. Changes to These Terms

We may update these Terms from time to time. Continued use of the website after updates constitutes acceptance of the revised Terms. The latest version will always be available on this page.

20. Entire Agreement

This Agreement, including any documents incorporated by reference, (including the Dashing Pets Disclaimer Document, Privacy Document, Returns and Refunds Document, Terms of Use Document) constitutes the entire understanding between the parties concerning the subject matter hereof.
